Terms and Conditions of Contracting
These General Terms and Conditions of Contracting govern the purchase of products through the Website https://joselito.com hereinafter, "the Website" or "JOSELITO". By accepting these General Terms and Conditions of Contracting, the User declares:
That they have read, understand, and comprehend what is set out herein.
That they are a person with sufficient legal capacity to contract.
That they assume all obligations set forth herein.
That they are of legal age (18 years) to purchase the products offered therein.
1. Description of the Purchase Procedure
The procedure to contract the products offered through the Website is as follows:
Select the product: The User who wishes to purchase a product offered through the Website must click the "Buy" button. Before clicking this "Buy" button, the User may review the detailed description of the product they wish to purchase. The Member may continue with the purchasing process until they have selected all the products they wish to order through the Website.
Purchase Confirmation: Once all the products have been selected, the User will be able to see the selected products along with a summary of the order. If they wish to continue shopping, they must click on the "Continue shopping" button. Otherwise, they will click the "Checkout" button.
Identification: The User must identify themselves as a Member. If they are not a member of JOSELITO, they may register to continue the purchase.
My Cart/Shipping details: Next, the User must complete a specific form related to the order shipment. A User who has already entered their shipping details previously will not need to fill in this information again. Otherwise, before confirming the payment details, they must provide the shipping information as well as the billing details. Once this information is completed, they may click the "Review order" button.
Customer details and secure payment: The User must fill in a specific form related to the order shipment. A User who has already entered their shipping details previously will not need to fill in this information again. Otherwise, before confirming the payment details, they must provide the shipping information as well as the billing details. Next, the User must choose a payment method between credit card payment or bank transfer to confirm the order. Before moving to the next step, the User can, before validation, view a summary of the order. Then, they must click the "Complete Purchase" button and will be redirected to the payment platform corresponding to the chosen payment option.
Payment confirmation: Once the order is confirmed, the Member will see confirmation of receipt of the order. The order will be processed once JOSELITO receives payment confirmation according to the payment method chosen by the Member in the step "Customer details and secure payment". The Member may continue shopping once this purchase process is completed.
Once the purchase process is completed, the User will receive an email with the order information (order number, purchased products, delivery times, and shipping costs information).
2. Shipping Conditions
JOSELITO ships its products exclusively within Spain. Shipping costs, depending on the delivery area, shall be borne by the buyer. These costs vary depending on the shipping zone and the total weight of the order.
For purchases over €100, JOSELITO will not charge shipping costs for delivery to any address in mainland Spain.
For purchases over €200, JOSELITO will not charge shipping costs for delivery to any address in Spain Balearic Islands-Ceuta-Melilla.
For purchases over €400, JOSELITO will not charge shipping costs for delivery to any address in the Canary Islands.
Orders will be delivered to the delivery address freely designated by the User, within the timeframe indicated on the product page. JOSELITO has arranged with its logistics partner the possibility of a second delivery attempt, at no additional cost and coordinated with the User, in the event that the User is not at the shipping address on the first delivery attempt. However, JOSELITO will not be held responsible when delivery cannot take place due to the inaccuracy or falsity of the information provided by the User, or when delivery cannot be made due to reasons beyond JOSELITO’s control, such as the absence of the recipient in both delivery attempts set forth in the contracting conditions.
JOSELITO cannot be held responsible for delays in delivery caused by circumstances not directly attributable to JOSELITO, nor for reasons beyond the company’s control such as unforeseen events or force majeure.
3. Price of Products Offered on JOSELITO
The prices of the products offered on the Website include, unless expressly stated otherwise, Value Added Tax (VAT) or other applicable taxes, and in any case will be expressed in Euros (€).
For any information regarding the order placed, the User may send an email to store@joselito.com. In all cases, the order number assigned must be indicated, as stated in the confirmation email of the purchase.
Some products offered in this online store are sold by weight, while others are sold as whole pieces at a fixed price.
In the case of products sold by weight (for example, sliced cold cuts), the final price will be calculated according to the exact weight of the delivered product, applying the per-kilo price indicated on the product page.
For products sold by unit (for example, whole ham shoulders), the displayed price corresponds to the total price of the piece, regardless of its exact weight. In such cases, an approximate weight and an indicative price per kilo will be provided for informational purposes only.
4. Right of Withdrawal
You have the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days after the conclusion of the contract. This right excludes products purchased as fresh meat, opened sliced products, or any other product delivered sealed where the seal has been removed, as well as those that expire quickly or are directly excluded under Article 103 of the Consumer Law.
You may use the withdrawal form model provided below, although its use is not mandatory. You may use any other unequivocal statement. If you choose this option, we will promptly acknowledge receipt of such withdrawal on a durable medium (e.g., by email). To meet the withdrawal deadline, it is sufficient that your communication regarding your exercise of the right of withdrawal is sent before the withdrawal period expires.
Consequences of withdrawal:
In case of withdrawal, we will refund all payments received from you, including delivery costs (except for any additional costs arising from your choice of a delivery method other than the least expensive ordinary delivery method offered by us) without undue delay and in any event no later than 14 days from the date we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment you used for the initial transaction. We may withhold reimbursement until we have received the goods. You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the date you notify us of your decision to withdraw from the contract. The deadline will be met if you return the goods before the 14-day period has expired. The merchandise must be delivered with seals and packaging intact in its original packaging. You must bear the direct cost of returning the goods. You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Applicable Law and Jurisdiction
These General Conditions are governed by Spanish law.
If you are contracting as a consumer, for the resolution of possible disputes, the parties agree to submit, at your choice, and waiving any other jurisdiction to which they might be entitled, to the courts corresponding to the Member’s or User’s domicile.
If you are contracting as a business, the parties agree to submit to the Courts and Tribunals of Salamanca, expressly waiving any other jurisdiction that may apply.
