Terms and Conditions

These General Terms and Conditions govern the purchase of products through the websitehttps://joselito.comhereinafter referred to as “the Website” or “JOSELITO”. By accepting these General Terms and Conditions, the User declares:

That you have read, understand and comprehend the above.

That you are a person with sufficient capacity to contract products and services.

That you assume all the obligations set forth herein.

That you are of legal age (18 years old) to purchase the products offered therein.

1. Description of the purchase procedure

The procedure for contracting the products offered through the Website is as follows:

Select the product: The User who wishes to purchase a product offered through the Website must click on the “Buy” button. Before clicking on the “Buy” button, the User may consult the detailed description of the product they wish to purchase. The User may continue with the purchase process until they have selected all the products they wish to order through the Website.

Purchase Confirmation: Once all the products have been selected, the User will be able to see the selected products and will be shown a summary of the order. If the user wishes to continue shopping, they must click on the “Continue shopping” button. Otherwise, they may click on the “Pay” button.

Identification: The user must identify themselves as a Registered User. If they are not a member of JOSELITO they can register to continue shopping.

My Cart/Shipping Details: The User must then fill in a specific form related to the shipment of the order. Users who have already registered their shipping data at an earlier point in time will not be required to fill in this information again. Otherwise, before confirming the payment details, the User must include the shipping details of the order, as well as the invoicing data of the order. Once the User has filled in this information, they can click on the “Review order” button.

Customer data and secure payment: The User must fill in a specific form related to the shipment of the order. Users who have already registered their shipping data at an earlier point in time will not be required to fill in this information again. Otherwise, before confirming the payment details, the User must include the shipping details of the order, as well as the invoicing data of the order. The User must then choose a payment method between payment by credit card or bank transfer to confirm the order. Before proceeding to the next step, the User can view a summary of their order before validating it. The User must click on “Finalise Purchase” to be redirected to the payment platform corresponding to the chosen payment option.

Payment Confirmation: Once the order is confirmed, the Registered User is shown confirmation of receipt of the order. The order will be processed once JOSELITO has received confirmation of payment of the order according to the method chosen by the Registered User in the step “Customer details and secure payment”. The Registered User may continue shopping after this purchase process has been completed.

Once the purchase process has been completed, the User will receive an e-mail with the information related to the order (order number, products purchased, delivery times and information on shipping costs).

2. Terms and conditions of shipment

JOSELITO ships its products exclusively to Spain. Transport costs, depending on the area of delivery of the products, shall be borne by the purchaser. These shipping costs vary according to the delivery zone and the total weight of the order.

For purchases over €100, JOSELITO will not charge shipping costs for delivery to any address in mainland Spain.

For purchases over €200, JOSELITO will not charge shipping costs for delivery to any address in Spain, Baleares, Ceuta, Melilla.

For purchases over €400, JOSELITO will not charge shipping costs for delivery to any address in Spain Canary Islands.

Orders will be delivered to the delivery address freely designated by the User, within the period established in the product sheet. JOSELITO has contracted with its logistics partner the possibility of a second delivery attempt coordinated with the User, at no additional cost, in the event that the User is not at the delivery address at the first delivery attempt. However, JOSELITO shall not assume any responsibility when the delivery of the product is not carried out as a result of inaccuracy or falsity of the data provided by the User for this purpose, as well as in the event that the delivery cannot be made for reasons beyond JOSELITO’s control, such as the absence of the recipient in the two delivery attempts set out in the terms and conditions of contract.

JOSELITO cannot be held responsible for delays in the delivery of orders for reasons not directly attributable to JOSELITO, nor for causes beyond the company’s control, such as acts of God or force majeure.

3. Price of the products offered in JOSELITO

The price of the products offered on the Website include, unless expressly stated otherwise, Value Added Tax (VAT) or other taxes that may be applicable and, in any case, shall be expressed in Euro currency (€).

For any information about the order placed, the User may email store@joselito.com. In any case, the order number assigned to you must be indicated and indicated in the purchase confirmation e-mail.

4. Right of withdrawal

You have the right to withdraw from this contract within a period of 14 calendar days without need of justification. The withdrawal period shall expire 14 calendar days after the conclusion of the contract. To exercise the right of withdrawal, you must notify us at: CÁRNICAS JOSELITO. The following are excluded from this rightproducts purchased as fresh meat, sliced products once opened or any other product that is delivered sealed and whose seal is removed, as well as those that expire quickly or that are directly excluded in article 103 of the Consumer Law

You will be able to use the form of withdrawal that appears below, although its use is not obligatory, being able to use any other unequivocal statement. If you make use of this option, we will inform you without delay in a durable medium (e.g. by e-mail) that we have received your cancellation. In order to comply with the withdrawal period, it is sufficient that the communication concerning your exercise of the right of withdrawal is sent before the expiry of the withdrawal period.

Consequences of withdrawal:

In the event of your withdrawal, we will refund you all the payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of standard delivery offered by us) without undue delay and in any event no later than 14 days from the date on which we are informed of your decision to withdraw from this contract. We will proceed with the refund using the same payment method you used for the initial transaction. We may withhold reimbursement until we have received the goods. You shall return or deliver the goods to us without any undue delay and, in any case, at the latest within 14 days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before the 14-day period has passed. The goods shall be delivered with the seals and packaging intact in their original packaging. You will have to bear the direct cost of returning the goods. You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods

5. Applicable law and competent jurisdiction

These General Terms and Conditions are governed by Spanish law.

If you are contracting as a consumer, for the resolution of possible disputes, the parties freely agree to submit to the courts and tribunals of the city corresponding to the domicile of the Registered User or User, waiving any other jurisdiction that may correspond to them.

If you are contracting as a company, the parties agree to submit to the Courts and Tribunals of Salamanca, expressly waiving their own jurisdiction if they have one.
